AV&H Obtains Antitrust Clearance without Second Request for Ball Corporation's $577 Million Acquisition of certain Anheuser-Busch InBev Assets
This past August, the U.S. Department of Justice declined to issue a request for additional information with respect to Ball Corporation’s proposed acquisition of certain Anheuser-Busch InBev’s beverage aluminum can manufacturing assets. ABI's Metal Container Corporation is a leading producer of aluminum beverage cans and Ball is the largest manufacturer of metal beverage cans in the United States. The deal, announced last July, is valued at $577 million and involves Ball’s acquisition of three beverage can plants, one can end plant and related contracts. Throughout the course of the Hart-Scott-Rodino waiting period, the AV&H team, led by partners Stephen Axinn and John Harkrider, successfully presented arguments and evidence to the Department of Justice to avoid the issuance of a second request.
